Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Nocturne (the “Service”), operated by Nocturne Inc. By using the Service you agree to these Terms.

Accounts & organizations

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account and within organizations you own or administer, including members you invite.

Acceptable use

You agree not to misuse the Service. You will not:

• break the law or infringe others’ rights;
• attempt to access data or accounts that are not yours, or probe or bypass security;
• disrupt the Service or place an unreasonable load on it, including via automation; or
• upload malware or unlawful, harmful, or abusive content.

Subscriptions & billing

Paid plans are billed through Stripe on a recurring basis (monthly or yearly) until canceled. Fees are stated at checkout and on our pricing page. Plan limits apply per your tier. You authorize us to charge your payment method for the final subscription total shown in Stripe Checkout.

Cancellation & refunds

You can cancel anytime from Settings; access continues until the end of the current billing period. None

Intellectual property

We and our licensors own the Service and its content. You retain ownership of the content you submit, and grant us the limited rights needed to operate and provide the Service.

Disclaimers & limitation of liability

The Service is provided “as is” without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, Nocturne Inc will not be liable for indirect, incidental, or consequential damages, and our total liability is None.

Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or to comply with law. On termination, your right to use the Service ends and we may delete your data subject to our retention obligations.

Governing law & changes

These Terms are governed by the laws of Miami-Dade County, Florida, without regard to conflict-of-law rules. We may update these Terms; material changes will be posted here with a new effective date, and continued use constitutes acceptance.
